Background:
 

The Carabell/Rapanos Supreme Court decision has led to uncertainty over the extent of Clean Water Act jurisdiction, not only for the Section 404 program, but for the whole Clean Water Act.  The Section 404 program is the only program under the Clean Water Act that is not administered chiefly by the states and the uncertainty over jurisdiction has raised the visibility of the challenges this creates in accomplishing the overall goals of the Act.  In order to protect water resources, improve responsiveness to permit applicants and develop holistic watershed approaches, improved coordination and cooperation between the U.S. Environmental Protection Agency (EPA), the U.S. Army Corps of Engineers (Corps), the states and the tribes is needed.  The purpose of this annual workshop is to help state and tribal wetland program managers and federal agencies respond effectively and cooperatively to protect federal, state, and tribal waters.  Presentations and discussions during the three day workshop will help participants prepare for the challenges ahead.

  Goal: To identify priority actions and to ensure the states, tribes, and federal agencies have information needed to effectively integrate Section 404 with other Clean Water Act programs. Specifically:

State Program Development ­- Removing the barriers to State Assumption of the Section 404 program and State Programmatic General Permits. Delegating Water Quality and Flood Prevention Programs to the States.

Policy Changes ­- Implementation of Section 404, 402, Stormwater, TMDL watershed plans and 319 watershed plans to achieve an enhanced watershed approach.
 
 ·
Jurisdiction ­- Identifying opportunities for the Corps, EPA, States and Tribes to share information about jurisdictional determinations.
 
·  
Mitigation ­- Coordinating state, tribal and federal development of stream mitigation criteria. Integrating wetlands mitigation into watershed management plans.
 
·  
Accountability ­- Compliance and enforcement of permits. Dealing with violations.
 
·  
Scientific Standards ­- Using stream restoration techniques, wetland assessment methods, wetland mapping tools, and other innovations to support regulatory and non-regulatory analyses and decision-making at the state, tribal and federal levels.

    NCTC is located at 698 Conservation Way, Shepherdstown, WV 25443 approximately 75 miles from Washington, D.C. The NCTC campus provides full-service residential facilities, complemented by professional staff and the most advanced technology available.

  Room Rates:
       
    Single Occupancy: $121 per night. This includes all meals.
   
    Double Occupancy: $81 per person for each individual attending the meeting. This includes all meals.
     
    Non-meeting attendees: If you have an additional person staying in your room who is not attending the meeting there is no additional charge but they will have to pay for food. The additional person would pay a la carte. The food is great and reasonably priced.
